About these terms

These terms and conditions ("terms") apply to the website techtrendidea.com and to all services provided by Tech Trend Idea ("Tech Trend Idea", "we", "us" or "our"), a company registered in India (CIN Coming Soon) with its registered office at Plot No. 54, 2nd Floor, Industrial Area, Phase 8B, Sector 74, Mohali (Sahibzada Ajit Singh Nagar), Punjab 160055, India.

By using the website, accepting a quote or paying for a service, you ("you" or "the client") agree to these terms. A signed proposal or project agreement for your project forms part of these terms, and if the two differ, the signed document applies.

Our services

We provide website designing, website development, CRM development, ERP development, AI automation and business consultancy services, as described on this website. The exact work for your project, called the "scope", is set out in your written quote or proposal.

Quotes are valid for 30 days from the date they are issued. Prices and package contents on the website may change, but the price in a quote you have accepted does not.

Scope and change requests

We deliver what is written in the agreed scope. Requests for new features, pages or changes after the scope is approved are "change requests". We tell you the cost and the effect on the timeline in writing, and start the work only after you approve it.

Prices, taxes and payment

• All prices are in Indian rupees and exclude Goods and Services Tax, which is charged at the applicable rate (currently 18%).
• Website projects are billed 50% in advance and 50% before go-live. CRM, ERP and automation projects are billed 40% at the start, 40% when testing begins and 20% at go-live, unless your quote says otherwise. Consultancy is paid at booking, and maintenance plans and retainers are paid in advance.
• You can pay by UPI, debit and credit cards, net banking and wallets through our secure payment gateway, or bank transfer by NEFT, RTGS or IMPS.
• A GST invoice is issued for every payment.
• If a payment is more than 15 days overdue, we may pause work until it is cleared, and the timeline moves accordingly.

Refunds are covered by our refund and cancellation policy.

Your responsibilities

• Share the content, information, access and approvals we need, within the agreed times.
• Make sure that any content, images, logos or data you give us belong to you or that you have permission to use them, and that they are lawful.
• Give feedback on each delivery within 7 working days.
• Keep your passwords safe after handover.

Delays on your side extend the timeline. If a project is on hold for more than 60 days because we are waiting on you, we may close it and bill for the work completed.

Timelines, delivery and approval

Timelines are given in working days and start once we receive the advance payment and the content needed to begin. We deliver all work digitally, as described in our shipping and delivery policy.

Each stage is shared with you for review. Approval by email or WhatsApp counts as written approval. If we receive no feedback within 7 working days of a delivery, that stage is treated as approved.

Ownership and intellectual property

• Once you have paid in full, you own the custom designs, code and content we create specifically for your project.
• Until full payment, all rights in the work remain with us.
• We keep the rights to our own tools, code libraries and know-how used in your project, and give you a permanent licence to use them as part of your project.
• Third-party items, such as open-source software, themes, plugins, fonts and stock images, remain under their own licences.
• We may show your project in our portfolio and marketing, unless we have agreed in writing to keep it confidential.

Third-party services

Projects often use services from other companies, such as domain registrars, hosting providers, payment gateways, WhatsApp, SMS and email providers, and AI models. Their own terms and prices apply, their charges are paid by you at actual cost, and we are not responsible for their outages, policy changes or price changes.

Confidentiality

Both of us will keep the other's confidential information private and use it only for the project. We sign a separate non-disclosure agreement on request.

Support and warranty

We fix defects in our own work that are reported during the free support period included with your project, at no cost. This does not cover problems caused by changes made by others, third-party updates or outages, hosting failures or misuse.

Search rankings, sales and advertising results depend on factors outside our control, such as search engine algorithms and competition, so we do not guarantee specific rankings or revenue.

Limitation of liability

Our total liability for any claim relating to a project is limited to the amount you paid us for that project. We are not liable for indirect or consequential losses, such as loss of profit, business or data, except where the law does not allow this limit.

Indemnity

You agree to compensate us for any claims, losses or costs caused by content or materials you provided, or by your use of the deliverables in breach of the law or these terms.

Ending a project

Either party may end a project by written notice. You pay for the work completed up to the notice date, and refunds follow our refund and cancellation policy. We may end a project if payments are not made, if these terms are seriously breached, or if the project would break the law.

Acceptable use

We do not build websites or software for unlawful purposes, including gambling, adult content, counterfeit goods, misleading schemes, or content that promotes hatred or violence. You must not use our work for such purposes.

You may use this website for lawful purposes only. Its content, design and images belong to Tech Trend Idea and may not be copied without our written permission.

Events beyond our control

Neither party is responsible for delays caused by events beyond reasonable control, such as natural disasters, epidemics, government orders, power or internet failures, or strikes. Timelines move by the length of such events.

Governing law and disputes

These terms are governed by the laws of India. If a dispute arises, we will first try to resolve it through discussion within 30 days. If it is not resolved, it will be referred to a sole arbitrator under the Arbitration and Conciliation Act, 1996, with the seat and venue at Mohali (SAS Nagar), Punjab and the proceedings in English. Subject to this, the courts at Mohali (SAS Nagar), Punjab have exclusive jurisdiction.

Nothing in these terms limits any rights you have as a consumer under the Consumer Protection Act, 2019.

Changes to these terms

We may update these terms from time to time. The version in force on the date you accept your quote applies to that project.
